These Terms are authoritative only in English and Spanish. Any version of this page shown in another language, including automatic or browser translation, is for convenience only, may be inaccurate, and is not binding. 1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you ("you", "user", "visitor") and HostingPR ("HostingPR", "we", "us", "our"), a business based in Vidalia, Georgia, USA. By accessing this website, using the AI assistant ("Sophia"), submitting the contact form, or purchasing any service, you agree to these Terms, to our Privacy Statement, and you knowingly and voluntarily accept all risks of using this website and its services. If you do not agree, do not use this website or its services.

2. The services we provide

HostingPR offers website creation, domain setup, managed hosting, lead capture, and an AI assistant, organized in tiers. What you receive depends on the tier you purchase:

We do not guarantee search rankings, traffic, lead volume, sales, revenue, uptime of third-party networks, or any specific business outcome. Results depend on your market, offer, and factors outside our control. Any examples, estimates, or timelines are illustrative, not promises.

6. Disclaimer of warranties ("AS IS")

To the fullest extent permitted by law, the website, the AI assistant, and all services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, secure, error-free, or free of harmful components, or that any output will be accurate or reliable.

7. Assumption of risk

You knowingly and voluntarily assume all risks arising from your access to and use of this website, the AI assistant, and the services, including risks of inaccurate AI output, reliance on information found here, service interruptions, data loss, and actions you take based on the services. You are responsible for maintaining your own backups and for any decisions you make.

8. Limitation of liability

To the fullest extent permitted by law, HostingPR and its owner, team, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, goodwill, or business interruption, arising out of or relating to the website, the AI assistant, or the services, even if advised of the possibility. Our total aggregate liability for all claims relating to the services will not exceed the greater of (a) the total amount you actually paid HostingPR for the service giving rise to the claim during the three (3) months before the event, or (b) USD $100. Some jurisdictions do not allow certain limitations; where that applies, the limitations apply to the fullest extent permitted.

9. Indemnification

You agree to defend, indemnify, and hold harmless HostingPR, its owner, team, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use or misuse of the website, AI, or services; (b) content or information you submit; (c) your violation of these Terms or any law; or (d) your infringement of any third party's rights or any harm you cause to a third party.

10. Third-party services

The website and AI rely on third-party providers (for example hosting, content delivery, AI model, and messaging providers). We are not responsible for the acts, omissions, availability, or policies of third parties, and your use may also be subject to their terms.

11. Payment, billing, and cancellation

Pricing is presented in U.S. dollars and confirmed in a consultation before work begins. Setup fees are charged before build; monthly fees recur monthly. No payment is ever collected inside the chat. Service is month-to-month: you may cancel any time, and service runs through the paid period. Fees already paid are non-refundable except where required by law. Monthly maintenance covers security updates, a routine functionality check, and one minor copy change per month; hands-on support is capped at one hour per month, with additional support available as a paid add-on.

12. Intellectual property

The HostingPR name, marks, site design, and content are owned by HostingPR. On full payment, you own the content you provide and receive a license to use the delivered website for your business; underlying templates, code, and tooling remain ours.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Any dispute will be resolved by final and binding individual arbitration administered in Georgia under the rules of a recognized arbitration body, rather than in court, except that either party may seek relief in small-claims court or seek injunctive relief for misuse or intellectual-property matters. You and HostingPR each waive any right to a jury trial and to participate in a class, collective, or representative action. Any claim must be brought within one (1) year of when it arose.

14. Changes and severability

We may update these Terms; the current version is always posted here with its effective date, and continued use after changes means you accept them. If any provision is found unenforceable, the rest remain in effect, and the unenforceable part will be limited to the minimum necessary.
